A report was submitted to SCAI which alleges that a violation of the Student Conduct and Honor Code (Code) occurred.

Just because a report has been submitted does not mean that you are responsible for a violation of the Code; there is a presumption that you are not responsible.

You should have received an Incident Receipt Letter; you will soon receive a Notice Letter which explains the steps of the process, including the opportunity to attend an Information Session. Your Notice Letter will explain the rights that you have in the process, and it contains important resources, so please review this letter carefully.

Following an Information Session, there may be a need for further investigation and relevant resolutions options will be explained to you.

If you received any communication from SCAI regarding an interim measure (such as interim suspension or a No Contact Directive), you are encouraged to carefully read that communication because it may contain additional steps in the process which are available to you.

You are welcome to bring an advisor with you to any meeting that you have with a representative from SCAI. An advisor may not delay the scheduling of any proceeding, and if your advisor speaks on your behalf, you will be responsible for the truthfulness of what they say. Additionally, you are responsible for communicating relevant information to your advisor.

No—there may be some very valid reasons as to why you may not want to participate as a Respondent (ex: you have an on-going criminal case involving the same matter that is being adjudicated by SCAI).

However, any effort to participate in the process, including by sharing your perspective or proving relevant witnesses and materials, may be helpful during the adjudication process.

If you choose not to participate, the proceedings will continue without you.

The timeline for adjudication is dependent on a variety of factors, including the complexity of the case, current case load, and the resolution options you select.

A list of sanctions and remedies available under the Code can be found in Section 16 of the Code, and range from a warning to expulsion.

Processes external to FIU are separate and must be resolved separately. Being a member of the FIU community comes with different rights and responsibilities than being a member of the general society.

If you believe there is an immediate threat of violence or unlawful behavior, please call FIU Police (MMC: 305-348-5911/BBC: 305-919-5911) or 911.

If you think that there is an issue which rises to the level of a Code matter in a non-emergency situation, please complete an Incident Reporting Form.

If you think that someone needs help either because of changes in their behavior, or disclosed to you financial needs, or unexplained absences, please report these to the Office of the Dean of Students via their Incident Reporting Form so that assistance and resources may be offered.

We know that it may be concerning to report matters to the university, but doing so helps to protect you and your fellow Panthers.

Information that is reported to the University will remain private, and it will only be shared with the parties that need to know or which are involved in the Code adjudication process.

If you have any concerns for your or someone else’s safety, the Code provides for the implementation of interim measures to help ensure the well-being and safety of community members.

Your perspective in an alleged situation is important. You are being invited to share your recollection of what you saw/noticed or you have information that would be important for the office to know.

Failure of any witness to appear shall not require a delay or affect the validity of the proceedings. If called witnesses do not appear, their written statements, if they exist, will be considered by the Hearing Body. Witnesses can appear in person or by contemporaneous alternative means (e.g., Skype, phone).

Under the Code, there are multiple amnesty provisions which may be offered to you report an incident or are called in for an investigation. Additionally, please remember the Medical Amnesty provision in the Code.
